Can text messages be used to prove adultery in divorce cases if I subpoena my husband's text messages?

In Ohio, you still need to prove a cause of divorce. Adultery is one of the causes, which under some circumstances can result in a division of property in favor of the injured party. When using documents for evidence, they must be authenticated. That means someone must say they are real or they may be considered hearsay and inadmissable. There are arguments possible to get around the hearsay rule. Please consult a family law attorney for information about the necessity for cause of a divorce in Ohio and what it may mean for you before you proceed.

If the respondent is in default for not coming to the initial divorce hearing, do they have to show up for any further hearings?

No, there is nothing that compels them to go to any hearings but they run the risk of having the court make an order without their input or objections.

How much does it cost to have an attorney handle an uncontested divorce case?

default-avatar
Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
Does uncontested me that the other party will sign the final Judgment and you agree on all terms? Or does uncontested mean that the other party won't get involved at all and you will have to obtain a Default Judgment? Or does uncontested me that you don't think there will be any disagreements on division of assets, division of debts, child custody and visitation, child support, spousal support, etc? Those scenarios would have different costs. Contact some local attorneys and ask for a free consultation.
