How can you modify a divorce that has been finalized in a different state?

Answered by attorney Amber Yerkey James
Divorce lawyer at New Beginnings Family Law, PC
Your question does not have a simple answer. Jurisdiction to modify a decree from another state depends upon several factors not the least of which is whether your former spouse still resides in the state of the original decree. Further, in some types of cases, the appropriate jurisdiction may be where your former spouse resides, some types of cases it is where the children reside. Your question is highly fact specific and you really need to meet with an experienced family law attorney in your area to discuss all the different possibilities.

You need a consultation with a divorce law specialist or both of you should meet with a divorce law specialist jointly for mediation purposes. I cannot tell you whether you have an alimony obligation or what the duration should be without asking a whole host of questions about your financial setting as well as your wife’s current employment setting (and if she is not working full time, determining a fair level of income to impute to her for full-time employment).  If nothing else, it is probably worth your while to pay for 1-2 sessions with a family law specialist for mediation purposes. If nothing else, it will flesh out your respective positions and hopefully, the lawyer will be able to give you recommendations for the settlement of those claims.

Legal terminology

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
Your quesiton is a bit confusing.  If you have a signed court order (that the judge signed or that your ex-wife signed) that allows you to lower alimony when she moves, and you did that, you are following the court order.  Although the language maybe self serving, if she consented to it, that's now biding.
