Generally, in America, marriage is a legal status. A person cannot remarry if they are only legally separated. No remarriage is legally valid unless the party was unmarried at the time, read that divorced. "House marriages" where the party officiating does not require a marriage license, register the marriage with the authorities, and performed knowing that one of the persons is separated but not legally divorced are both invalid and potentially illegal. A person who knowingly marries another while they are married to a different person is a bigamist, which is a crime.

You should not file a simplified dissolution and file a Petition for Dissolution of Marriage without Children. He can then sign a waiver of service, sign all of the required documents and you could appear alone at the final hearing. Not a problem, it can be done easily, but not quite as easy as a simplified dissolution. I hope this helps. Good luck!

You need to get to a local attorney and find out what can be done. You can file in Florida, and it is probably the best place to file if you have been a resident for more than 6 months, and especially if your marriage was last intact here. Is he paying support to you for the child? There are two basic ways to go: uncontested, or contested. Uncontested is when you both agree on the resolution of all of the issues, and contested is when there is just one issue, or more, that the parties do not agree upon. If it is uncontested, the cost will be much less. So, try to agree with him as to shared parenting, a time sharing plan, the division of assets and debts. The amount of child support should also be agreed to, but there is a specific statute that must be followed.
