Am I entitled to my husband's property if we get a divorce?

Answered by attorney Victor L. Waid (Unclaimed Profile)
Divorce lawyer at Law Office of Victor Waid
This property interest of your husband appears to be separate property assumining no comingling of the property with the community property acquired during marriage. The short answer is no unless he has either agreed to transfer an interest in the property to you during marriage by writing or verbal agreement.

He should not be able to do anything to get a default as long as your mother put her address on the proof of service.

I want to get a divorce as fast as i can and i live in california but was married in nevada and my wife is in jail in illinois. What can i do?

It does not matter where you married, it matters where you reside.  Since you reside in California, you can file here and serve your spouse in Illinois (she can be served while incarcerated). If you wish to divorce in Nevada, you would need to contact an attorney or court in that state to see what their rules are since states have different laws with regard to divorce. In California, a divorce takes a minimum of 6 months and 1 day from the date of service.  It can take longer.  In most cases, similar to yours, the respondent does not respond and the divorce becomes a 'default divorce'.  Depending on your issues, or lack thereof, your divorce may or may not require a hearing.
