My husband and his attorney are refusing to participate in a settlement conference, is trial the only option left?

Generally, a party in a divorce case is strongly encouraged by the Judge to engage in good faith settlement negotiations. The Judges have ways to motivate people to participate in settlement conferences but they cannot actually force someone to negotiate in good faith. I think your instincts are good about him being unreasonable and it could very well be that your husband has decided to refuse to negotiate with you because he thinks that he can steamroll you when the case goes to trial since you do not have an attorney.

Can you be divorced after being widowed?

Dead people can not file for divorce. Mothers can not file for daughters. If there are children, you are the person the court will give them to first unless there is a reason not to do so.

If I divorce my husband is he entitled to any of my NJ State monthly pension income?

Richard Scott Diamond
Answered by attorney Richard Scott Diamond (Unclaimed Profile)
Divorce lawyer at Diamond & Diamond, P.A.
Fortunately, you are mixing apples with tomatoes. If you are married for at least 10 years, your spouse has the ability to apply for social security benefits at retirement based on your contributions into the system as opposed to benefits based on his / her history of contributions into the social security system. That "entitlement", has nothing to do with your employment related pension plan. If your pension plan was for employment prior to your marriage ( and you were not married while contributions were being made into that plan) your spouse has no claim to share in the monthly benefits from it for equitable distribution purposes.
