The very best thing to do is to have a full discussion with a local family attorney. You might have to publish in the newspaper, and in order to do that you have to make diligent inquiry about where the spouse is. Child support may or may not be an issue, depending upon the facts of the case, as well as the visitation.

A quit claim deed is different than a grant deed. A grant deed will convey not only property that the person who executes it owns, but property they subsequently acquire. A quit claim deed is different. It only deeds property that the person has title to at the time. If they don't hold title at the time they execute the quit claim, nothing gets conveyed to the grantee.

At this point, not much. It was sold and became community property. If he still has the cash when you get divorced, you are entitled to half of it. If he spent it, it is presumed that he spent it on community needs. If he bought something with it, you will be entitled to one-half of the value of what he bought.
