Nothing about this process is "fair" by any definition. You really need to retain an attorney familiar with Family Law and creating plans for the disabled son. For example you should apply for Social Security SSI benefits for him. This proposal has no life insurance protection for you or the disabled child. If former husband dies before Wife, does she forfeit money she lives on? Too many unanswerable questions, you really need experienced attorney.

Well, the nightmare will probably continue. It sounds like somebody needs to hire an attorney to make sure they are protected. But in the great scheme of things, what does it matter to the siblings as to who gets the retirement benefits? #2 or #4, the kids aren't getting them, so let it go. If the siblings do not have an attorney, they should call the Idaho State Bar and get a referral. If the personal representative knows what he or she is doing, it may not take much effort on the part of the siblings attorney.

You do not have to move until you are evicted lawfully. However, you may want to begin making plans to move with your child. Once you are living apart from the father, you can request child support.
