You need to consult with an attorney in order to best determine what you may be potentially facing in the event of a divorce. In Florida, any asset or debt that was acquired during the marriage is considered a marital asset or debt and is subject to equitable distribution, which typically means 50/50, regardless of whose name it is in and regardless of who paid for it or incurred the debt. There may also be a potential alimony issue if you've been the sole provider; however, with only a 5 year marriage, any alimony obligation would only be for a short period of time. You need to consult with an attorney.

The best thing to do is to contact an attorney and see about getting a protective order or an injunction against her. You and your husband will have to go into great detail regarding all of the things that she has done. What you think is significant may not be legally, just as what you think is insignificant may in fact be legally important.

In short, generally no, you cannot, unless there has been domestic violence in some form, and even then, possibly not, because you are married and there is a child involved, even if it his child from a previous relationship. You may want to consider looking into doing a collaborative divorce in a situation like this, which generally is more cost-effective and time-effective than a litigated divorce.
