If there is no court order preventing you from going something, then you can do it. The question, I think, that is on your mind is whether there will be a consequence in a divorce if you move money out of your personal account into a family members account. The answer to that question is maybe. If the money in your personal account is "marital" in nature, then it would be normally subject to equitable distribution with your spouse. If it was earned by either party during the marriage, it is marital in nature. It is normal in a divorce to acquire bank statements going back perhaps 5 years as part of the discovery process. If you are trying to dissipate the marital estate prior to divorce, then it will probably not go unnoticed.

The most recent NJ Appellate Court decision on this issue is Mandelbaum vs Mandelbaum, where the husband claimed that the parties were not properly married and therefore wife was not entitled to benefits of their 20+ year marriage. The trial and the appellate courts disagreed with the husband and said that a court of equity will not permit the husband to disavow wife's entitlement to the benefits of their marriage ( ie alimony, equitable distribution, etc). The fact that your husband wants to annul your marriage does not mean that you have to agree to it. My suggestion is that you have a consultatoin with a family law specialist to discuss your rights. I have no idea what the terms of your divorce settlement agreement provided for but presumably you waived alimony or the judge handling your divorce matter asked you if you were waiving alimony. Presuming my understanding is correct, you would need to show a change in circumstance from the time of the divorce or you would need to show that the terms of the settlement agreement are unconscionable. Simply saying that someone from a divorce center was not available to meet with you at the time you signed the agreement, etc is not a legal basis for reexamination of an alimony waiver.
