I am wanting a divorce for some time, he got deported and I haven't heard from him since, what needs to be done?

Answered by attorney Kevin L. Dixler
Divorce lawyer at Law Office of Kevin L. Dixler
There is nothing stopping you from seeking a divorce other than the ability to hire an attorney and/or pay the filing fees. You ought to seek help from an family/divorce attorney. If you successfully petitioned him, then his deportation likely ended your responsibility for him based upon form I-864.  He can be served at his last known address whether in the U.S. or outside the U.S.  If that does not work, then likely by publication, but you must speak with an attorney licensed in Texas to seek legal advice for that matter.  Good luck. The above is general information, not legal advice, and does not create an attorney client relationship.

What is the percentage of income that can be designated for alimony after a divorce? How?

Mandy J. McKellar
Answered by attorney Mandy J. McKellar (Unclaimed Profile)

In Nevada there is no such formula for alimony, the court will consider all forms of income, and also look at money out for bills and expenses. It is based on need and ability to pay, and is governed by NRS 125.150. Alimony cases can be extremely tricky and I would recommend any one having issues in court with alimony to have competent counsel present to argue all the nuances that go with it.

My husband and I are both military and are stationed in Korea. I want a divorce ASAP and I’m pretty sure he is on board as well. What do I need to do?

Stephanie Elizabeth Emanuel

Because you are both deployed and active duty, its virtually complicated to get a divorce easily because you share benefits. You will need to be able to be off duty and back in your state or any county you chose to live in and qualify under the jursidiction residency requirement. Since there is a child involved, custody arrangement is also needed to be discussed. If you can discuss with your spouse matters such as millitary benefits and child custody issues, you can than proceed to an uncontested divorce. An uncontested divorce will cost you anywhere from $750 to $1,500 compared to a contested divorce with military background will run you anywhere from $2,500 to $5,000. Feel free to contact my office and speak with a case manager at 877-866-8665 or email help@smsattorneys.com.
