You have as much right to remain in the home as he does regardless of who pays the mortgage and other bills. Obviously, if there is physical violence involved, you should seek a protection order from the court.

You should start by talking to a local attorney.  In most states, your wife would not be required to sign any documents.  If she failed to cooperate then the Court may be able to enter a default judgment of divorce.    Stu Shafer
