What do I do if I found out I was still married to my first husband when I got married the second time?

Answered by attorney James Forrest Lentz (Unclaimed Profile)
Divorce lawyer at James F. Lentz Attorney & Counselor at Law
I am going to assume you are divorced from husband number one now. What to do next depends on how long you have been "married" to number two. To protect your options, please see a domestic relations attorney at once. Likely there is another wedding in your future, as well as a post nuptial agreement and a prenuptial agreement.

Is it possible to annul a marriage if both parties are in agreement with the process?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
Divorce lawyer at Anthony Overton Van Johnson Associates, P.C.
You must have acceptable grounds to annul a marriage. The fact that both parties desire an annulment is irrelevant. You must file the proper documentation and include the grounds for which you are seeking an annulment. The court then will make a decision whether or not you have provided sufficient grounds and evidence. Otherwise, the court will require that the annulment be converted to a divorce action.

Marshal Willick

Generally, all property (including retirement) accrued during marriage is equally divided upon divorce. Also review the Child Custody, Child Support, and Spousal Support and Alimony pages. You should consult with expert family law counsel.
