In order to get you to testify, the City Attorney would have to subpoena you by personal service within California. If you are out of state, they would not be able to force you to testify. Whether or not the charges would be dropped would be up the City Attorney handling the case and whether there is enough evidence to convict the defendant without your testimony. Hope this helps.

The only thing I can think of is to request a copy of the police report from the prison. The DA's may have a record of the charge being refused. See if you can get that from the DA in the county where the prison is located.

When you go to court, you may still be fingerprinted and arrested. Right now you just have a citation or copy of charges. See website for info on retaining the right attorney.
