Will my girlfriend be convicted even if the charge was cancelled?

Answered by attorney James E Gandy (Unclaimed Profile)

In domestic violence cases, the police generally have a policy of arresting the offender. If your girlfriend was NOT arrested, the police simply thought this was a domestic dispute and NOT a crime. If an arrest did occur, the prosecutor/district attorney controls the charges. It will not matter if you no longer wish to pursue the matter. They will control the case.

What do you do when you get arrested for burglary in store with merchandise worth less than $500?

You will probably be charged with petty theft. Potential penalties are up to 1000 in fines and six months in county jail. "Fees" from the store are not included. Usually when property is stolen and the person is arrested, the property will be recovered by the store unless it is is damaged and not sellable.

Can I be charged if I am not home and the police search my house?

The police could try to prove possession by the fact that you lived there. It would then depend on where it was found and if it was in a place like a living room or a kitchen where everyone has access. If it was in with some papers that either had your name on it or were a woman's clothes they would argue that circumstantially the drugs belonged to you.
