Can I sue a County Sheriff's department?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
Been done by whom? You think the sheriff's department is GOD. Do you think all of the unsolved homicides in the United States are the result of police not trying hard enough? Do you think the police are guarantors of your safety? Have you made any effort to trace the calls yourself? Have you retained a private attorney to investigate? What role are you supposed to play in the entire thing? nothing? To answer your question: YES You can sue.

Can my 12 year old daughter be charged with burglary for a cell phone if it was never found on her possession?

Anything is possible. Whether or not the prosecutor will be able to prove their case is to be seen. I suggest that you hire an experienced criminal defense attorney to represent your daughter should the D.A.'s office decide to proceed with the charges.
