Yes, initially you should plead "NOT Guilty". If you plead guilty to the charge you will have a criminal conviction on your record for the rest of your life. Usually, especially for first time offenders, the DA (prosecutor) will offer the Defendant (you) the opportunity to plead guilty to a reduced charge which will not give you a criminal record. If you cannot afford a lawyer the court should appoint a lawyer to represent you, either Legal Aid or 18B. It depends where in NYS you are located and what court your case is in. Definitely speak to a criminal defense attorney about this case before you just plead guilty. Good luck!

A DUI offense (even a first DUI) carries mandatory significant and harsh penalties including; a license suspension, jail time, fine, an ignition interlock device, special insurance, an alcohol evaluation, ADIS class, DUI victim's panel, and 5 years probation. A DUI attorney can help mitigate those consequences and improve your situation. Due to all of those penalties very few judges in this State will actually accept a guilty plea from a DUI defendant at arraignment. I recommend you plead not guilty and speak with an attorney.

Although theft of under $50 can be an infraction, typically the DA will charge the misdemeanor petty theft. If so, you're looking at a theft offense that carries potential jail time, probation, fines and will stay on your criminal record indefinitely if you're convicted. You want to try and avoid a conviction if at all possible. That's where an attorney comes into play. Don't be shortsighted. You could be making decisions that can be very difficult, if not impossible, to undo and can have tremendous impact on your life.
