Assume you are charged with at least an A class misdemeanor you have a right to a jury trial. No one will ask you - its presumed you want a jury unless you waive it. If your finance refuses to comply with the subpoena the DA can get a material witness order and have your fiance arrested and brought before the judge for the purpose of setting bail (or no bail) to ensure appearance in court.

First see if Medicaid will cover the treatment. If not, legal aide should be able to renegotiate with the judge. He may offer a brief jail alternative or possibly community service or possibly there is another program that you can go to that will accept Medicaid.
