How should I answer a job application question when I was charged with stealing but it was amended?

John E. DeVito
Answered by attorney John E. DeVito (Unclaimed Profile)
Criminal Law lawyer at John DeVito
You should answer the question asked. If it asks if you were convicted you should state "no". If it asks if you have ever been charged with a crime then you must answer and explain. If they do a background check and then question you, then youshould disclose and explain what happened. You should also have available a certified copy of the Court Docket Sheet which will show the amended charge and the dismissal of the Receiving Stolen Property charge. Your other alternative is to attempt to seal your record.

How can I get my daughter's felony cleared?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
An early discharge is possible. There is no way to get the case to be expunged unless there is the case can be reopened through a Writ of Habeas Corpus, retried and she is found not guilty. If she received a deferred probation she may be eligible for a Non-Disclosure Order after the passage of five years from the end of the probation.

If an expunction order has been granted, can a gov’t agency use info such as the arrest record or indictment to revoke a nurse's license in a hearing

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
A true expunction should make the case never exist, so it should never be able to be used against you. Once expunged, it legally doesn't exist. You can sue anyone who reveals it.
