I agree with the private attorney you consulted with. Once you started going to court and the trial started, you most likely waived your right to a speedy trial which is what Serna is based on.

Sounds like a domestic violence case. The answer is yes they can still prosecute even if the wife refuses. What are the defendant's chances? Depends upon the facts, but if there are pictures and a previous statement made by the wife, I would say chances are not real good, but I would need to see the entire case.
