When should one hire a sentencing consultant?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
What in the world is a sentencing consultant? My advice would be to hire an attorney, not a "sentencing consultant" (if there is such a thing). You make it sound like you are negotiating your own plea agreement without an attorney. Your use of the term "sentencing consultant" further suggests to me that you are representing yourself. If that is the case, you're being foolish. If you needed a heart transplant, would you perform your own surgery? If I am wrong and you have an attorney negotiating for you, you should talk to him or her about this.

If a friend was caught with illegal material on his computer and is trying to pin it on me, should I agree to a polygraph?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Never talk to the police or agree to talk to the police or take any polygraphs without first consulting with a lawyer. Then decide if it is in your best interest to talk to the police or take a polygraph. You may want to arrange with your attorney, to take a private polygraph to see how well you perform on one.

Was it legal to arrest my wife when she was the raped?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

Whether your wife was sexually assaulted is an issue they were investigating. It is not illegal to arrest her if she was publicly intoxicated but that sure seems bad. File a complaint with the police internal affairs division.
