Status of a deferred DV conviction prior to 2013 law?

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Criminal Law lawyer at Miller & Harrison, LLC
Yes, he should be able to purchase a gun. A successfully completed deferred sentence results in dismissal of the charges - so no permanent conviction. However, the records sometimes aren't as clear as they should be so he MIGHT get denied initially but if he provides documentation showing dismissal of the charges, he should get permission to purchase a firearm.  Note: There is aprocess that he can follow to seal the records of this case since all charges were dismissed - so the fact of his arrest and court case will no longer show up on a public background check. The state court website has forms for it under the "self help " tab - or he can hire a lawyer to do the record sealing.

Can I own a firearm though I was a felon?

Gregory Charles Graf
Answered by attorney Gregory Charles Graf (Unclaimed Profile)
Criminal Law lawyer at Bertram & Graf, LLC
A convicted felon cannot possess a firearm. If your case was a deferred judgment and you successfully completed the deferred judgment, the guilty plea would have been withdrawn and the case dismissed. If this was the case, you can possess a firearm once the case was dismissed. If it was a straight conviction, you are prohibited from possessing a firearm under state and federal law.

What is the penalty for writing back checks and cashing them?

Answered by attorney Steven Jed Alpers (Unclaimed Profile)

The police may come after you. It could be a misdemeanor or a felony, probably a misdemeanor. You need to get the money and have it to repay the victim. That will help the disposition.
