Can I refuse a random drug test from probation and not go to jail for it and what would I have to say so I didn't have to take the piss test?

You might end up doing more than simply going to jail; depending on your conviction, you could end up in prison for failing a drug test. And if you happen to be on Prob 36 or PC 1000 probation you will lose the benefit of successfully completing those programs. Do yourself a favor; get the help you need to kick the drug habit.

What penalties would I have if this is my first offense for possession charges?

While it is doubtful that there would be any jail time given the general description of the circumstances, I would suggest that you engage an attorney immediately and do not speak with any of the authorities or investigating officers until you do so. Because of the effect on your future you should do everything in your power to try to avoid a conviction and a permanent record.

The best way to find an attorney is through a referral from a friend or relative. Otherwise you can Google "personal injury attorney (Your city and state)" and see what the search results are. You can contact your local county bar association for a referral.
