How do I get back evidence used against me if I won the case?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Unless it was not lawful for you to have the firearm in the first place, the police should give it back to you after the case is dismissed. It often takes them quite a while to do this but if it takes too long you can always file a motion with the court to have them return it or ask the prosecutor if they can get the police to give it back to you.

Should I tell the officer who contacts me that the details of the allegations are false, or should I just let my attorney handle it?

Mark Corwin Bruce

You should get a lawyer. The officer who calls you will be looking for the slightest mistake to determine that you are lying and that will give him probable cause to arrest you. It is very rare that someone can convince the police of their innocence. Get a lawyer and let the lawyer talk to the cops for you. This is a family law matter that was escalated by your boyfriend.

You should not have left them with him, retrieve them ASAP. You might have a peripheral liability but it is he who would have the primary ATF criminal liability. He cannot be in possession of any firearms.
