Can I get a restraining order against someone who lives with me?

Answered by attorney Jared Altman (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared Altman
Yes. You can. If this person commits a criminal offense against you, such as hitting, choking, throwing something at you, prevents you from calling 911 or the police, then you can try to file charges and if you are in fear for your safety, then a temporary order of protection will probably be issued by a judge. They are issued between married persons living together. So, of course they will issue against unmarried persons living together. Please note the following necessary legal disclaimer: I have not given legal advice. I only give advice to my clients. I am not acting as your attorney. I have not yet agreed to represent you. Anything I have said is based on limited information and may be subject to change as more facts become known. Attorneys express opinions. Attorneys often disagree. If you want further information or independent verification of anything I have said then you should immediately consult another attorney. Never sit on your rights!tate.

What happens once we bail out our son out of jail for domestic abuse battery 1st?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
Your son needs a criminal defense attorney who is skilled at presenting and handling domestic violence cases. Domestic violence convictions have grave consequences outside of a normal assault and battery charge. The next statement will be an advisement and arraignment on the charges. The government will most likely offer a plea deal at that time. Your son can accept the plea deal or set the matter for a jury trial.

How can I find out if my record is sealed?

Answered by attorney Jared Altman (Unclaimed Profile)

I do not believe that your record is sealed. If you were given youthful offender treatment then your conviction was probably vacated so you were never actually convicted after all. Otherwise, you've got a felony record and it will never be sealed.
