Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Unless his offense is a bondable offense and he is able to be bailed out, he will stay in jail until his case goes to trial. If you are not happy with the public defender, your only alternative is to retain private counsel to represent him.

In my legal opinion, you definitely should seek legal advice.  It should suffice to remind you that in the past several years numerous innocent inmates, who were wrongfully convicted, have been released.  Sadly, even though our justice system is probably one of the best in the world, it cannot stop innocent persons from being convicted.  Even with an attorney, an innocent person may be convicted -- but, hopefully, legal representation improves the odds.

Can he still get a free attorney even if we can get enough money to bail him out for his domestic battery charge?

Free attorneys are hard to come by. If your dad is indigent then he may be able to get a court-appointed lawyer but he has to ask the judge for one. These guys are not free however. Their rates are very low and payment may take time but they must be paid.
