If I was charged with a crime but wasn't indicted and it did not go to trial, will employers see this on my record?

Answered by attorney Seth David Schraier
Criminal Law lawyer at Law Office of Seth D. Schraier, P.C.
Private employers can only see your record which is not considered "sealed." A criminal conviction (misdemeanor or felony) will show up on a background check, but an arrest will usually not appear. The only instances where it has shown up in my experience, is where you need to consent to an FBI background check, which will still show any arrest you have ever had. There is no way to erase that, as it is only accessible to criminal justice agencies.

Is there any way I can handle my warrant from another state?

Answered by attorney Eric E Rothstein (Unclaimed Profile)
Criminal Law lawyer at Rothstein Law PLLC
What's the warrant for? Unless its for a summons, you can't deal with it from Maine. If it's for a summons, you can retain counsel to appear and resolve the case.

If someone tells the police that they don't want to press charges can the person change their mind?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Yes, that person can change their mind and as often as they want. Just keep in mind that when that happens, the police and prosecutor may be less inclined to believe you or wish to follow through with the charges. In the end however, it is always up to the prosecutor and the prosecutor alone on whether or not to pursue criminal charges.
