Is law enforcement legally obligated to notify the parent/guardian of a minor child that has been taken into custody?

Yes they are. Under the Family Court Act they are obligated to notify the parent/legal guardian. They are not supposed to question the minor before notifying the parent and without the parent or legal guardian present when the minor is given Miranda warnings. Statements made by the minor to the law enforcement may be suppressed for failure of the law enforcement to comply with this requirement.

If accused of theft at store without proof can my employer fire me and my boyfriend?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
He can fire you as Texas is an at-will employment state meaning that as long as it is not illegal discrimination, they can fire you for any or no reason. But, you can collect unemployment and if they oppose it, they would have to prove that you stole. As far as charges, unless he has proof, no prosecutor is going to take charges. And so what about the W4 and illegal immigrants or whatever. You bring that up as a threat but it has nothing to do with whether or not you stole or whether or not they can prove you stole.

What can I do to win an assault charge?

Answered by attorney Jared Christian Winter (Unclaimed Profile)

If you put her in the hospital, expect to be criminally prosecuted. Hire a lawyer immediately and hire a private investigator to get witness statements. When someone touches your face, you don't get a free pass to completely obliterate her in the name of "self-defense". Your defensive actions must be reasonable under the circumstances. You're going to need an experienced criminal defense attorney to sell it.
