To answer your question; you can sue the officer and the City that employs him/her. You can't sue the NYPD per se.  That being said, if your ticket was dismissed, please call our office and we can likely get you some award for the false arrest. The prosecutor may have decided to prosecute you with a misdemeanor assault charge based on strategy. It may be that the case against you is not very strong. You should have private counsel discuss the best way to defend your case.
