An attorney can file a petition on your behalf to expunge one criminal conviction. In Michigan, this can be done 5 years after you complete probation.

If you believe you are the victim of a crime and want to have the offender prosecuted, you can contact the police in the city where the crime occurred (assuming it occurred within city limits).  If it did not occur within any city limits, you can contact the Sheriff's Department for the county where the crime occurred.  You can file a complaint report and provide the law enforcement officer with information pertaining to why you believe a crime occurred.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Unless his offense is a bondable offense and he is able to be bailed out, he will stay in jail until his case goes to trial. If you are not happy with the public defender, your only alternative is to retain private counsel to represent him.
