Yes, you can be arrested for auto theft unless there was an agreement that you would keep the car until the money was returned (which you should have gotten in writing.) And, since the car is in the roommate's name, I can envision the roommate saying she wants her car back & you would definitely have to return it if she says it is hers because you have no agreement with her.

It is not required in all cases that the person arrested be shown the search warrant but if it was not obtained the search may be unlawful and the evidence may be suppressed. The determnation is in a case by case basis and depends on specific facts.

First of all, he is eligible to have his case transferred to juvenile court because he is only 17-yrs-old. Second, drug paraphernalia is not a very serious offense. If he is charged in adult court he will get a fine or diversion; if he is in juvenile court it will likely be diversion or probation. Assuming there is not more to the story and your son does not have a prior history of contact with law enforcement, he will be fine. If you are still worried contact a criminal lawyer near where you live.
