What can be done if my husband violated his probation this is his first time and it was because we forgot to tell them we moved it?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
Criminal Law lawyer at Anthony Overton Van Johnson Associates, P.C.
Your husband should retain an attorney. An attorney can negotiate with the probation officer and prosecutor to seek to have the probation reinstated. Or, in the alternative, the attorney can petition the court for reinstatement.

What are the chances of my boyfriend serving jail time for armed robbery even though he did not shoot anyone?

Nicole W. Moss
Answered by attorney Nicole W. Moss (Unclaimed Profile)
Criminal Law lawyer at Law Office of Nicole W. Moss
Just knowing the shooter is insufficient to charge someone with a crime. If your boyfriend was present at the time of the alleged robbery and there is any evidence that he participated or that he knew it was going to happen, then yes, he may very likely face charges. The fact that he has not been indicted yet gives him the opportunity to try and fight these charges before the indictment is handed down. If the prosecutor decides to take the case to preliminary hearing, your boyfriend's attorney can question the state's witnesses and proffer witnesses and evidence to support his side of the story. If the state goes to Grand Jury, the defense can still attack the case through somewhat different means. A lot of people make the mistake of waiting until after the charges are filed to hire an attorney. by fighting the charges before the case is indicted, you can sometimes prevent the indictment all together or reduce the number or severity of the charges filed.

Will my friend remain in custody or be placed in a program?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
You do not say what he is on parole for. You do not say what the new charge is. You do not say anything about his criminal history. If he has been in jail for a week, I suspect that the violation is substantial. Such being the case, I have no idea. It is ultimately up top the judge.
