If the prosecutor didn't have enough evidence to convict how can I win the civil case?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Because the burden of proof is different. In a civil case, the burden of proof is a preponderance of the evidence which is much lower than beyond a reasonable doubt for a criminal case. That is why even though he was not convicted at the criminal level, he could be found responsible at a civil trial.

It's probably too late to file an appeal, but you may be able to file a motion for early termination of probation and then expunge your conviction.
