Yes. Several reasons: at the time the person committed the crime, it was illegal. Also, while certain states (Washington and Colorado) recently made marijuana legal, the federal government still considers it illegal. There remains a conflict between federal and state law. This has yet to be resolved. Also, keep in mind that while alcohol is legal, you can also be arrested for violation of certain laws. Example: how old is this person? Is he/she of legal age? Was he//she DUI? would have to see the particular facts of this case, as that could also impact my answer.
