How can I surpass an assault and 3rd battery charges?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
Your best chance at getting a favorable outcome is to hire a talented attorney. Your attorney may be able to argue that the use of force was reasonable under the circumstances. Also, there may be avenues for getting evidence suppressed, depending on how the evidence was collected.

Is it legal for the DA and Attorney to come up with a plea deal if the Attorney has not met with his/her Client about the case

Answered by attorney Jose C. Romero
Criminal Law lawyer at Romero & Associates
Absolutely not, any sort of negotiation or offer should always be communicated to the client.  Additionally, a plea is invalid if the client does not accept it.  Now, dont confuse having a "plea deal" with simple negotiation.  The prosecutor will almost always try to negotiate to try to expedite cases.  Attorneys discussing a plea agreement does not mean having one until the client approves it.  Good luck.

Can he throw me under the bus in any way to get him out of any trouble while leaving me with more severe conviction?

You definitely need to hire an attorney to represent you. Your friend's attorney may try to allege that the marijuana belonged to you. Your attorney can negotiate a plea bargain with the prosecutor to hopefully get your drug charge reduced to a lesser offense, such as "Littering." My experience is in the St. Louis area courts, so it may be different outside of the St. Louis area. If you end up being convicted of drug possession, it will be on your permanent criminal record and can never be removed. A drug conviction can prevent you from getting a job, renting an apartment, getting accepted into a college, or getting a loan.
