How will an excessive speeding conviction in Hawaii affect my California drivers license?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
It is on your record and accessible to CA, and probably counts for points. Any state suspending a license will result in all states suspending their license as well. The HI paperwork may take time to catch up to CA DMV, but likely will.

What can I do about getting my criminal case expunged?

Answered by attorney Dennis Julian Roberts (Unclaimed Profile)
Criminal Law lawyer at Dennis Roberts A Professional Corporation
The law is unclear. Meanwhile look at Penal Code Sec. 1203.4. Bottom line is that record expungement is not that big a deal. It doesn't erase the rap sheet. It just adds a line to your rap sheet (C.I.& I) which says that relief was granted pursuant to PC 1203.4. In other words anyone looking at your rap knows what you were originally busted for. A certificate of rehabilitation is better.

Do you have to be read your rights no matter what happens?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
The quick answer is not necessarily. Miranda or "reading your rights" only applies to custodial interrogations. The first part means that the police have you in custody either physically or that you were not free to leave. The second part means they are asking you questions or saying things that would tend to make you say things against yourself. If the police arrested you, you were in custody, but if they did not question you (beyond routine booking questions) than Miranda would not apply. Even if your Miranda rights were violated, it does not mean that the case will be dismissed. It means that the prosecutor or DA cannot use those statements against you.
