Get a lawyer, tell them "the whole story" and maybe they can get the case dismissed or dropped down to an infraction or a simple trespass. It is important that you get the public defender if you can't afford a lawyer. Don't just walk in and plead guilty to the charge. Since it is a misdemeanor, you would be entitled to a lawyer if you can't pay for one.

Yes, if the victim agrees prior to the police getting involved. If the law enforcement officials (LEOs) have gotten involved it's more difficult because the LEOs job is to punish crimes against society which, in your case, the embezzler did. The victim's desire to forgive and forget goes a long way though, especially if they state they will not testify against the embezzler, which is very hard for an average victim to say.
