Does a cop have to read me my rights if I was put in cuffs but I did not go to jail?

Answered by attorney Jared Altman (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared Altman
The remedy for not being read your rights ("Mirandized") is that any admissions found to be involuntary that you may have made to the police cannot be used against you. It does not mean an automatic dismissal of the charges against you. The police know this so they don't bother Mirandizing you if they don't need your statements or a confession to prove your guilt.

If I asked to get private attorney at last court date and still have not secured one, can I get continuance?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
It depends upon how many times your case has been continued and your reasons for not yet securing an attorney to represent you. Since you requested a private attorney, lack of money to pay the attorney is not an excuse.

Sorry for confusion,I'm asking if my deferred sentence which I have violated means that I will go directly to doc or will I get a second chance?

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Criminal Law lawyer at Miller & Harrison, LLC
It is hard to answer this question definitively without knowing what county you are in, what the alleged violations of the deferred sentence agreemeent are and other facts. However, it is typical many times on a first alleged violation of a deferred sentence for the court to just find the violation as having occured, revoke the deferred sentence agreement, impose the permanent conviction for the crime you were on the deferred sentence for, place you on probation with the same or similar conditions as those on the deferred sentence, possibly at worst add a condition of county jail for a few days, or maybe community service work, etc.  - so I would be surprised if on this violation you went directly to Department of Corrections.
