Get an attorney and seek to keep this off her permanent record where it will follow her for the rest of her life and make sure she learns her lesson, otherwise it will be a waste of your time and money.

When he goes to his first appearance, will they release him?

John E. DeVito
Answered by attorney John E. DeVito (Unclaimed Profile)
Criminal Law lawyer at John DeVito
If this matter occurred in Massachusetts then the likelihood is that your boyfriend will be required to post bail in order to get released. Assault and Battery on a pregnant women is a felony. If he defaulted on a court date, the court will balance the seriousness of the crime and the fact that he defaulted on the court date when imposing bail. It would be beneficial for him to hire an experienced attorney for the bail hearing and for future proceedings in the case.

Does a DUI count as a second one if I got my first one in another state?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)
Criminal Law lawyer at Law Office of Joe Dane
The good news is that a DUI can only be used as a prior for 10 years in California, so it shouldn't impact your current one. The prosecutor may not even know about it, but they can't legally use it as a prior, so I anticipate you'll face a first time DUI here in California.
