Your Miranda Rights are not dependent on whether the crime is a felony or misdemeanor. Contrary to public belief, the police do not have to read you your rights every time you are arrested. They only have to read you your rights if they wish to interrogate you with incriminating questions while in police custody. Even if there was a Miranda violation, it would only serve to suppress any incriminating statements that you made or any evidence obtained as a result of those statements. A Miranda violation in no way effects the validity of the arrest. Television and movies are largely responsible for the public misconception on Miranda. Hope this clarifies things a bit.

It all depends on the crimes she was sentenced for and what the sentence was, as well as the sentencing date and any credits she already had built up at the time. If she said it was a crime of violence, then she's probably correct. The expected release date is usually the date the inmate is expected to be released assuming all credits that they are eligible for, are earned. You should be asking her attorney this question. They should be able to give you a good estimate because they would know the necessary details.

Some jurisdictions offer diversion programs for first time offenders (i.e., you take a class, take an HIV test, and stay out of trouble for a while and then they dismiss the case). Other jurisdictions don't. Technically, you can do jail time, but that is pretty unlikely for a first time offender. You would be wise to hire an experienced criminal defense attorney in your area to represent you.
