Don't plead guilty to that charge without an attorney. If you can't afford to hire one, then yes, go for the public defender. You want an attorney to evaluate the strength of the evidence and also the legality of the stop before you just plead guilty. First offenses for HS 11550(a) are usually handled handled through PC 1000 diversion. You can't get PC 1000 if you have drug priors, but I'm assuming you don't have drug priors or you wouldn't be asking. If you do have priors, there are other options for you. If you don't want to do any type of program, the minimum amount of jail time for HS 11550(a) is 90 days.
