What happens on your first time being caught with a gun?

Answered by attorney Richard Wagner
Criminal Law lawyer at The Law Office of Richard Wagner, A Professional Corporation
It depends on what the DA charges you with. Sometimes the DA will want to put you on probation and make you pay a fine or do Cal Trans. Depending on the circumstances, you might be able to fight the case and win because the cops acted illegally in searching you and seizing the gun. Once you go to your Arraignment you will be told what the charges are and you will have a better idea of what you are facing.

What charges will my friend face for being caught with meth?

He faces possession of meth charges. With no prior record, maybe 6-8 months in jail, followed by 5 years on probation.

Am I entitled to get time credited from my original sentence?

No, because you were doing that time on a former case, not the case you are dealing with now. You would have been better letting them issue a warrant on the new case and then you would be doing time on both cases. Sorry. But why don't you ask your lawyer as I am not sure I have all the facts.
