Under federal law, it is unlawful for any person who has been convicted of a felony to possess any firearm or ammunition. A person is not considered to have been convicted of a felony if the conviction has been expunged, unless the expungement expressly provides that the person may not possess a firearm. States also have their own laws on the subject. Sometimes an expungement is not really an expungement, but just a dismissal. When a conviction is truly expunged, it is erased, as if it never existed. It becomes a legal nullity. By contrast, some states, like California where you are from, have statutes that allow felony convictions to be dismissed (which they term an expungement.) One example is a law applicable to people who have successfully completed probation for certain felonies. However, the statute expressly provides that the expungement has no effect on certain rights, and the defendant is not released from all penalties and disabilities resulting from the felony offense. Among the exceptions is the right to own or possess a firearm. Thus, while under California law, the crime of possession of a weapon by a former felon requires both conviction of a felony and ownership or possession of a firearm, if your conviction was expunged under a statute that expressly states it does not restore your right to possess a firearm, you are still subject to the prohibition. If your conviction was dismissed pursuant to this statute, another possibility is for you to apply for a certificate of rehabilitation and pardon. If granted, you may be allowed to possess a firearm. Since you have not provided any details about the nature of your expungement, I recommend you not take any chances. You should consult an experienced criminal defense attorney who can review the files from your prior felonies, including the documents relating to the expungement, and advise you as to whether your convictions were expunged for all purposes, or whether the prohibition against owning or possessing a firearm is still in force.
