Is there any way to get a different judge for sentencing after a jury trial?

This is an extremely difficult thing to do.  In order to get a new Judge, you would need to file a motion with the presiding Judge, stating that he or she was biased towards you and acting in a manner that caused you prejudice in front of the Jury.  Obviously, this would require the Judge to admit wrongdoing.    You could then file the motion with the Chief Judge of the Court and allege the same acts.   If you would like to discuss this further, and perhaps explore other options, please contact me.   Eric Lumberg 248-626-8383 lumberglaw@gmail.com
