How can you get a restraining order for a domestic violence case removed set by a judge in California?

default-avatar
Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Criminal Law lawyer at Steven J. Alpers, A Professional Corporation
You probably cannot if the case went to hearing. If you went to hearing there would not be a good chance of overturning a judge's decision on the facts. If you are still awaiting your hearing you need a lawyer to fight the order.

What can my friend do if her attorney is not helping her case?

default-avatar
Answered by attorney Carina Laguzzi (Unclaimed Profile)
Criminal Law lawyer at Laguzzi Law, P.C.
There may not be anything to update your friend on which is why the attorney hasn't talked to them. The attorney may not be calling you back because you are not the client. With th attorney-client privileged, there is little the attorney can talk to someone (other than the client) about the case. Have your friend write the attorney if he is dissatisfied to try and mend the relationship. If that does not work, the client should consider hiring a new attorney.

What do we do about a case that hasn't been filed for four years?

default-avatar
Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)
Criminal Law lawyer at Law Office of Joe Dane
Your question starts with "four years" but then says "four months". If it's only been 4 months, then that's not necessarily time to worry. Many DA's offices are backlogged and it may take them 6 months to get to your case. Besides - why are you in such a rush to get charges filed against you? If it goes longer than a year, the statute of limitations runs out and they can't go forward. If it has been 4 years, the statute of limitations is way past and the prosecution cannot file charge against you. Either way, you should be discussing this with the attorney you hired.
