Short answer - yes, the state can 'charge' you for possessing something that is not on your person. It appears that you are confusing two ideas - allegations with convictions. The state - via the prosecutor and/or police - can claim, or allege, that you possessed something that was not found on your person. This will require them to somehow indicate that despite these items not being on your person you exercised dominion or control over them. This is how they would charge you with possession and this is based entirely upon what they claimed happened. The next step, they would have to convince a jury that what they are alleging is true. This is required for a conviction.

You should ask your Attorney or Public Defender what probationary requirements you have to complete. Normally, informal probation status does not require that you have a probation officer, or require that you do any blood or urine testing. However, different Judges may require testing, so check the Court records, or check with your Attorney. If that doesn't get you the answers then get an experienced Attorney to help you. Better to be safe than sorry.

Unless you know how to effectively represent yourself in all this, hire an attorney who does. The conventional wisdom is that the attorney will be able to get you a better deal than you could on your own, or effectively try the case if forced to that. That is what you are paying for. If serious about hiring counsel, and if this case is in SoCal courts, feel free to contact me. If not, then go to your Arraignment hearing and plead not guilty. Youll be provided a copy of all the police reports and charging Complaint. There youll have to set a date for Pre-Trial hearing where negotiations with the DA are first conducted. If the case is not plea bargained, it will be set for Trial. Prior to that, youll file any appropriate Motions. Generally, if you are charged with simple possession of small amounts, and it is your first offence, your attorney may be able to get you a drug diversion program that avoids jail and conviction.
