Sentenced to five years in prison, or on probation. If defendant was on probation, and violated probation, and was sentenced to prison, the defendant will serve whatever sentence the judge indicated to be served in prison. There is no credit for jail time with time spent on probation, unless the probation was originally served on first offender probation. This is a difficult question to answer, because you are missing some pieces.

The punishment could be a horrendous amount of time in jail. I do not think you have the number of counts right. On the facts you presented there should only be one count of burglary and perhaps two counts of grand theft. Since it is his first offense, depending upon the negotiations with the state attorney, he could wind up doing a few years of probation. He definitely needs an aggressive criminal defense attorney. Look some up on LawQA in your area, and get some consultations.

If the person makes a request for a hearing, then s/he is entitled to a hearing within 20 days. Generally people do not do this because some times it is best to sit in jail (take your punishment) and then the judge will release the person back on the probation. This works many times. There is no set time limit but as long as they are sitting in jail, they are getting credit towards their final sentence in the event that they are revoked.
