I do not beleive there is a law requiring it but I do believe if asked, the law enforcement agency likely will return it (so long as it is a legal firearm) and if not a motion can be filed with the court asking that the Judge order them to return it.

If a person has been indicted then the statute has been satisfied, provided the DA issues it. SOL is about the time it takes the state to investigate and bring charges. Once charges are filed then the statute is satisfied. After filing, there are speedy trial limitations.

You can't. You either gut it out with the public defender that was appointed to represent you, or you pay to hire your own private representation.
