If the state want to give 4 years but offering 30 months, should the person take the offer? How much of the sentence will be served out of 30 months?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
I have no idea what the charges are or what the facts are. How could I possibly advise anyone to take the offer without thoroughly investigating the facts and coming to my own conclusions about how to defend the person? I will never do that. The person would be doing 85% of the time, or 25.5 months.

What can I do at my hearing to dismiss the disorderly charges?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
If the officer never saw them, then that makes your case a little better. That means the prosecution would have to track down witnesses. As for getting the charges dismissed, that is up to the prosecutor. Having a good attorney could help you there. Your attorney can negotiate with the prosecutor and point out the weaknesses of the case.
