Can I get DUI and possession if I refuse a breath test and had a small bag of marijuana?

When you say you refused the breath test, do you mean the "PBT" (which is the hand-held unit the police officer has you blow into at the stop scene) or the "Breathalyzer" (which is the breadbox-sized machine you blow into at the police station) ? The implications of refusing them are VERY different. I would kindly but strongly recommend you consult with a DUI Lawyer like myself to assess all your available defenses.

I'd need a lot more info to answer that. What kind of drug charge? (possession for personal use? sales? manufacture? cultivation? importation? transportation? possession on school grounds? selling to kids? under the influence? theft from a pharmacy? etc.) Obviously, I have no idea whether or not you have a defense or if you might be eligible for some type of diversion program.
