The state will not try him unless he is competent to stand trial. Everytime he is manic, he will be sent to a facility to get stable, because as you write there is no point in discussing anything. He will not be released on bond, because as you write when he is manic there is no point in discussing anything.

She is not being released to anyone, because she is grown. She is being released and allowed to reside with certain persons. Who she is allowed to reside with is a decision of parole.

Legally or realistically? Of course, it is a crime to attempt to commit a crime. This means that, technically, you could be arrested for offering to buy mushrooms. Realistically, I wouldn't lose any sleep over it. No offense, but you are an extremely "small fish". The detectives who work the narcotics bureau are not interested in wasting their time to pursue someone who offered to buy a small amount of drugs for personal use. Their buddies would laugh at them if they did. I wouldn't worry if I were you. Good luck.
